Tmall Global Pre-sale Business Management Rules 2
After payment of the Deposit, if a Buyer does not pay the Balance Due on schedule, or where the Buyer applies for a refund and it is determined in accordance with the “Tmall Global Rules”, “Dispute Resolution Rules” and other related rules, that the Seller is not responsible, the Deposit will not be refunded.
Where a Buyer pays the Deposit, and pays the Balance Due on schedule, yet the Merchant delays in delivering the goods and the status of the order is listed as “transaction closed”, the case will be handled in accordance with the “Tmall Global Rules” and related rules. At the same time, the Merchant must compensate the Buyer the amount of which should be equivalent to the Deposit paid by the Buyer.
Where a Buyer pays the Deposit, and pays the Balance Due on schedule, yet the Merchant delays in delivering the goods and the status of the order is listed as “transaction successful”, the case will be handled in accordance with the “Tmall Global Rules” and related rules.
Article 13 [Management of Balance Due]
(1) When using the Third Stage Tmall Global Pre-sale Tool:
During pre-sale, both the pre-sale price and Deposit of Tmall Global Pre-sale Item will be displayed simultaneously on the goods description page, customers may check the Balance Due when they pay the Deposit;
After the pre-sale, the Balance Due will be determined according to the final number of buyers and will be displayed at the “Goods Already Purchased” webpage, customers may view the Balance Due to be paid at the webpage.
2、Using the First Stage Tmall Global Pre-sale Tool:
The Balance Due for the Tmall Global Pre-sale Item is fixed, the price and Deposit amount ofTmall Global Pre-sale Item are displayed on the goods description webpage.
(3) Balance Due payment method:
The Balance Due must be paid in accordance with the transaction process set up of the Tmall Global system.
Article 14 [Management of Goods Delivery] The delivery time must be fulfilled in accordance with the “Delivery Time” described on the Tmall Global Pre-sale Item description page. The delivery time must be specified.
Article 15 [Inventory Management] Merchants using Tmall Global Pre-sale Tools to sell goods must, when applying to join pre-sale activities, report to Tmall Global the amount of inventory of the pre-sale items. The number must not be reduced and can only be increased after reporting.
Article 16 [Return Policy] Consistent with other Tmall Global transactions, Tmall Global Pre-sale Items do not support seven (7) -day return / exchange without reason.
第五章 市场管理Chapter 5 Market Management
Article 17 [Code of Conduct] Tmall Global Pre-sale Merchants must follow the following codes of conduct:
(1) During pre-sale, unless the item is sold out, Tmall Global Pre-sale Items must not be taken off the shelf;
(2) During the pre-sale of Tmall Global Pre-sale Items, Merchants cannot sell such items through other sales channels offered by Alibaba Group. Other sales channels of Alibaba Group include, but are not limited to, cross-store discounts, package deals, quick discounts, Juhuasuan general sale activities etc;
(3) Must comply with other special rules of special categories.
Chapter 6 Handling of Violations
Article 18 [Measures against Violations]
1、All goods sold by a Merchant will not be allowed to apply for Tmall Global Pre-sale Activities within one (1) month of the violation;
2、All goods sold by a Merchant cannot apply for Tmall Global Pre-sale Activities within three (3) months of the violation;
Article 19 [Handling of Violations] Where a Merchant takes part in a Tmall Global Pre-sale Activity and commits one of the following violations, Tmall Global will handle the violation in accordance with the Tmall Global Rules, and, starting from the day the violation is detected, simultaneously handle the violation in the following manner:
1、Where the delivery time of goods is not clear, all goods sold by the Merchant will not be allowed to apply for Tmall Global Pre-sale Tools within one (1) month of the violation;
2、Apart from where goods are sold out, a Merchant takes pre-sale items off the shelf during pre-sale, all goods sold by the Merchant will not be allowed to apply for Tmall Global Pre-sale Tools within one (1) month of the violation;
3、During pre-sale, where a Merchant carries out sales through other sales channels offered by Alibaba Group, Tmall Global has the right to prohibit all goods sold by the Merchant from applying the Tmall Global Pre-sale Tools within one (1) month of the violation;
4、Where there is a delay in delivery of Tmall Global Pre-sale Items, Tmall Global has the right to prohibit all goods sold by the Merchant from applying the Tmall Global Pre-sale Tools within one (1) month of the violation;
5、Where Tmall Global Pre-sale Items forms part of a False Transaction, all goods sold by the Merchant will not be allowed to apply for Tmall Global Pre-sale Tools within three (3) months of the violation;
Chapter 7 Supplementary Rules
Article 20 Where an act of a Tmall Global Pre-sale User occurs before these Rules take effect or are revised, the Rules at the time of the act will apply; where the act of the pre-sale occurs after these Rules take effect or are revised, these Rules will apply.
Article 21 A “month” as referred to in these Rules is every thirty (30) days, and not a calendar month.
Article 22 These Rules were revised on March 26, 2015, and were officially implemented on April 16, 2015.
IN CASE OF ANY INCONSISTENCY BETWEEN THE TWO LANGUAGE VERSIONS, THE CHINESE VERSION SHALL PREVAIL.
