Tmall Global Qualification Management Measures for Operating Stores
In order to establish good business order and improve shopping experience and shopping quality for customers, the following Qualification Management Measures are drafted in accordance with the Tmall Global Rules.
Authenticity of Qualifications
Merchants must ensure the authenticity of their qualification documents (where the related qualifications of the Merchant, such as trademark registration certificates, power of attorney etc., are provided by a third party, the Merchant must first verify the actual effectiveness of the documents). Where Merchants provide forged or altered qualifications and documents to Tmall Global, Tmall Global will have the right to terminate cooperation with and dismiss the Merchant in accordance with the “Tmall Global Business Services Agreement” and the “Tmall Global Rules”. The Merchant will also be included in the bad faith customers list, and Tmall Global will not cooperate with such Merchant again.
Three months before a Merchant’s qualification expires, a “Merchant Center-Store Reminder-Qualification Reminder” submission window will be opened for changes in qualifications. Merchants must submit qualification changes in a timely manner. Where a Merchant delays the submission of changes or the qualification changes are not accepted, Tmall Global will impose Store Supervision on the Merchant until the qualifications are up to standard. In serious cases,Tmall Global will have the right to terminate cooperation and dismiss the Merchant.
Qualification Review Regulations
Tmall Global has the right to conduct regular reviews or special reviews of a Merchant’s qualifications.
If during a regular review, a Merchant’s qualification fails to meet the standards, the Merchant must submit supplemental qualifications as required within fifteen (15) days. If the Merchant fails to supply qualifications or the main qualifications are not up to standard, Tmall Global will impose Store Supervision; in serious cases, Tmall Global will have the right to terminate cooperation and dismiss the Merchant. If a Merchant is unable to supply qualifications or the brand and goods qualifications submitted are not up to standard, Tmall Global will immediately revoke the corresponding brand license and take the related goods off the shelf. In serious cases,Tmall Global will have the right to terminate cooperation and dismiss the Merchant.
If during a special review, Tmall Global discovers that a Merchant’s brand and goods qualification is not up to standard, it will first revoke the relevant brand license and take the related goods off the shelf; the Merchant must submit supplemental qualifications as required within fifteen (15) days. In serious cases, Tmall Global will have the right to terminate cooperation and dismiss the Merchant.
Special review applies in the following circumstances:
Tmall Global has the right to carry out special review of a Merchant’s qualifications based on judicial investigations, administrative supervisions, media reports, public questioning, third-party complaints or other circumstances;
Tmall Global has the right to carry out special review of a Merchant’s qualifications based on information obtained through the course of market order management or transaction disputes.
In order to protect customers’ right to information and other legal rights and interests, to ensure the authenticity and legality of materials submitted by Merchants, and to ensure that service agreements signed between Tmall Global and Merchants are effectively implemented,Tmall Global, in accordance with the circumstances, has the right to engage professional institutions to verify the authenticity and legality of the related materials submitted by Merchants.
在资质复检过程中，天猫国际有权根据不同情形决定采取包括但不限于，指示Alipay.com Co., Ltd对商户货款采取止付措施及/或对消费者自动确认收货时间进行调整等措施。该等处理措施至资质复检及相关处理流程完全完成时终止。
During the qualification review process, Tmall Global has the right to, according to different circumstances, carry out measures that include, but are not limited to, instructing Alipay.com Co., Ltd to cease the Merchant’s goods payment and/or adjusting the time a customer can automatically confirm receipt of the order etc. These handling measures will cease when the qualification review and related handling procedures have been completed.
Content of Qualifications
The aforementioned qualifications include, but are not limited to, the following content (“Tmall Global Merchant Invitation Standards”, Tmall Global Business Contract Renewal Standards)
After a brand license is revoked, if a Merchant wishes to continue its operations, the Merchant may go to “Merchant Center – Store Management – Brand Management” and re-apply to include the brand in accordance with rules such as “Tmall Global Merchant Invitation Standards” ，renewal standars and other relevant rules;
If a Merchant, due to invalid qualifications, has Store Supervision imposed, the annual technical service fee will be applied as normal during the supervision period.
IN CASE OF ANY INCONSISTENCY BETWEEN THE TWO LANGUAGE VERSIONS, THE CHINESE VERSION SHALL PREVAIL.
